Employers are becoming increasingly concerned with ensuring that they are compliant with the management of employees with who they know or perceive to have a “qualified disability” as defined under the Americans with Disabilities Act (ADA). This management packet was designed to assist EMS agencies with maintaining compliance with the ADA. Employers are obligated to engage all employees with whom they know or perceive to have a qualified disability to determine if there is a reasonable accommodation that would permit the employee to perform the essential functions of their position.
This packet includes a Reasonable Accommodation Request Form that employers can utilize to ask the affected employee to specifically identify what the nature of their disability is and the accommodations that they are requesting that will allow them to perform the essential functions of their position. The employer can utilize the Reasonable Accommodation Interactive Process Form that will lead the employer through the interactive process and permit them to consistently approach and document all ADA Accommodation requests.
