There has been a steady increase in positive workplace drug testing for the last several years. The legalization of recreational and medical marijuana has driven this trend leaving U.S. employers struggling with maintaining a culture that is safe and compliant. The majority of the states in the U.S. have some form of legalized marijuana and many states have passed legislation that prohibits basing hiring decisions on the results of a pre-hire drug screen. The law is evolving quickly nationwide and it is increasingly important that employers follow a consistent workplace drug policy and drug testing process.
This Workplace Drug Packet is intended to provide employers with a consistent manner in addressing drug use in the workplace. The Reasonable Suspicion Checklist will assist frontline supervisors and employers more consistently manage and address the suspected use of drugs and alcohol in the workplace. The Reasonable Suspicion Checklist provides frontline supervisors with a consistent process for when they suspect an employee may be utilizing or under the influence of drugs or alcohol while working.
The packet also includes a Sample Last Chance Agreement for employers to utilize when they encounter an employee who has been identified as struggling with a substance abuse problem but whom has requested or is required to enter a substance abuse treatment program as a condition of continued employment.
